This timely book gives an overview of the main legal issues the EU faces in negotiating, concluding and implementing so-called ‘New Generation’ free trade agreements. Featuring contributions by international specialists on EU external action, this book demonstrates why these FTAs have become challenging for the EU, as well as analysing how the EU has dealt with its institutional constraints, and addresses contemporary debates and future challenges for EU institutions and Member States.

Contemporary trade policy is increasingly framed in geo-strategic terms. But how much of that rhetoric is reflected in actual policy choices by the EU or its trading partners? This book provides a first systematic study of the broader international context in which EU trade agreements are conceived, negotiated, and designed. Building on a refined conceptualisation of geo-economics, the book develops a cogent framework that combines insights from scholarship on the design of free trade agreements with ideas from foreign policy analysis. Empirically, the analysis focuses on the relations between the EU and the Asia-Pacific. Following the United States’ pivot to Asia and the EU’s Global Europe strategy, China’s backyard has become the main arena in which global powers’ geo-economic strategies overlap. Building on a series of case-studies, combining the perspectives from the EU and its trading partners, the book shows that the rhetoric of geo-economic competition is yet to catch up with the actual negotiation and design of free trade agreements. This volume will be of great interest to scholars, students and practitioners who want to gain a holistic understanding of contemporary trade negotiations.

The rise of cross-regional trade agreements is a defining trend of the current international trade system as shown by the signing of the Trans-Pacific Partnership (TPP) in 2015, the negotiations for the Transatlantic Trade and Investment Partnership (TTIP) between the USA and the EU as well as the Regional Comprehensive Economic Partnership (RCEP) between countries in Asia and Oceania. These differ from previous agreements in their economic significance and large geographic scale, and the wide scope of trade-related issues. The current rise of nationalist and isolationist ideologies across Europe and the USA has raised questions on the future of cross-regional trade deals and made the need to understand their implications for economic and political governance ever more urgent. Two main forms of governance that are central to this volume are the democratic tensions over new generation trade deals on the one hand, and their geopolitical ramifications on the other, which have come into collision to herald the advent of a highly uncertain period of world politics. Many of the questions tackled in this volume, surrounding the democratic governance of trade agreements – whether long-held debates on the inclusion of workers’ voices, controversies on intrusive "behind the border" provisions undermining national sovereignty and local autonomy or new questions on digital rights – are crucial to understand the ebbing popular support for far-reaching trade agreements. This book will be a useful learning tool for students and scholars in a wide range of fields, including Globalisation, Global Governance, International Political Economy, International Trade and Investment and International Law, and should also be of interest to EU trade negotiators, international policymakers and business associations.

Exploring the contentious relationship between trade and labour, this book looks at the impact of the EU’s ‘new generation’ free trade agreements on workers. Drawing upon extensive original research, including over 200 interviews with key actors across the EU and its trading partners, it considers the effectiveness of the trade-labour linkage in an era of global value chains. The EU believes trade can work for all, claiming that labour provisions in its free trade agreements ensure that economic growth and high labour standards go hand-in-hand. Yet whether these actually make a difference to workers is strongly contested. This book explains why labour provisions have been profoundly limited in the EU’s agreements with the CARIFORUM group, South Korea and Moldova. It also shows how the provisions were mismatched with the most pressing workplace concerns in the key export industries of sugar, automobiles and clothing, and how these concerns were exacerbated by the agreements’ commercial provisions. This pioneering approach to studying the trade-labour linkage provides insights into key debates on the role of civil society in trade governance, the relationship between public and private labour regulation, and the progressive possibilities for trade policy in the twenty-first century. This book will appeal to research scholars, post-graduate students, trade policy practitioners, policy researchers allied to labour movements, and informed activists.

The Comprehensive Economic and Trade Agreement between the EU and Canada (CETA), proposed Transatlantic Trade and Investment Partnership between the EU and the US (TTIP), and the plurilateral Trade in Services Agreement (TiSA) between the EU and 22 other States have sparked a great deal of academic and public interest. This edited collection brings together leading experts in the field of international economic law to address the legal complexities of these treaties and provide an explanation of their core principles. In the first two chapters, this book examines changing conceptions of international economic law and the main motivations for negotiating mega-regional agreements. In nine further contributions, international experts examine sectoral issues such as the trade, investment, and dispute settlement procedures envisaged in these 'mega-regional' agreements. The book goes on to consider the progress made in intellectual property protection, the problems associated with data protection, human rights, labour, and environmental standards, issues of transparency and legitimacy, and the relationship between CETA, TTIP, and TiSA on the one hand and EU law on the other. A trade deal between the two economic powers has become an increasingly popular notion, particularly given increased competition from China. Old arguments against a transatlantic deal have become weaker as the balance of the world's economies has changed. Such an agreement would generate significant gains if designed properly and would encourage global trade liberalisation. It is time for the EU and US to press ahead with a free trade agreement. The EU and US also need to find a way outside of the WTO system to use their economic power as leverage in their dealings with emerging economies. An ambitious free trade agreement can, therefore, achieve more than the benefits of reducing barriers.

On October 6, 2010, the 27 member European Union (EU) and South Korea signed a bilateral free trade agreement (FTA). The agreement is expected to go into effect on July 1, 2011, pending approval by the European Parliament and the South Korean National Assembly.
