The Right To Health In International Law

Lack of access to health care is one of the fundamental problems facing people in both developing and developed countries. This book examines the history, foundation, and meaning of the right to health in international law. It concludes that it is possible to offer an understanding of this right that is practical and capable of being implemented.

This interdisciplinary study engages with the fields of human rights law, health law, and public health. It analyses how the internationally guaranteed human ‘right to health’ is realized by States at a national level. It brings together scholars from more than ten different countries, with each of them analyzing the right to health in their country or region. They all focus on a particular theme that is important in their country, such as health inequalities, the Millennium Development Goals, or the privatization of healthcare. This book is relevant for scholars, practitioners and policy makers in the field of human rights law, health law, public health and the intersection between these three fields.

Institutions matter for the advancement of human rights in global health. Given the dramatic development of human rights under international law and the parallel proliferation of global institutions for public health, there arises an imperative to understand the implementation of human rights through global health governance. Contributing chapters each map the distinct human rights efforts within a specific institution of global governance for health. Through the comparative institutional analysis in this volume, the contributing authors examine institutional dynamics to operationalize human rights in organizational policies, programs, and practices and assess institutional factors that facilitate or inhibit human rights mainstreaming for global health advancement.

In response to the call of the 48th World Health Assembly for a substantial revision of the International Health Regulations, this new edition of the Regulations will enter into force on June 15, 2007. The purpose and scope of the Regulations are "to prevent, protect against, control and provide a public health response to the international spread of disease in ways that are commensurate with and restricted to public health risks, and which avoid unnecessary interference with international traffic and trade." The Regulations also cover certificates applicable to international travel and transport, and requirements for international ports, airports and ground crossings.

The alarmingly low health status of millions of people in many developing countries is now recognised as a major obstacle to the process of development.
