Excerpt from The Law Magazine and Law Review, or Quarterly Journal of Jurisprudence, Vol. 27: March to August, 1869 The law reforms effected by that proverbial reformer, Justinian, were to some extent of the composite character just sketched. He was not content with issuing simply a code or digest; but he promulgated both, as also a brief summary of legal principles, together with various collections of the Imperial rescripts, though, unhappily, he did not weld these together. We thus find historical analogy as well as first principles to be altogether on the side of a comprehensive system of reform, such as the Law Digest Commissioners seem to contemplate. The codification of French law under the First Napoleon, with so few elements of a digest, was of practical use, only because old rules of law and of interpretation were purposely ignored to a great extent by the disciples of the political school of '89. Were the Third Napoleon now to reconstruct the French codes, the additions thereto would doubtless consist mainly of decisions passed under sections of the existing compilation.
