Regional Environmental Law Under The Auspices Of The African Union Au

The African Convention on the conservation of nature and natural resources was adopted in 1968 in Algiers. Considered the most forward looking regional agreement of the time, it influenced significantly the development of environmental law in Africa. Two and a half decades of intense developments in international environmental law made it necessary to revise this treaty, update its provisions and enlarge its scope. This was undertaken under the auspices of the African Union (previously OAU), and the revision was adopted by its Heads of State and Government in July 2003 in Maputo. The introduction provides an overview of this new international treaty, as well as a commentary to each of its provisions.

An Introduction to the African Union Environmental Treaties sheds light on the African Union legal regime related to environmental issues and provides expert analysis of how the African Union has transitioned from the former management of natural resources approach to strategies of preservation and protection. This book explores different areas of the environment, from livestock to plants, fertilizers, minerals and marine environment. C.O.OKIDl1 I welcome the opportunity to prepare a Foreword to the book on Environmental Policy and Law in Africa, edited by Kevin R. Gray and Beatrice Chaytor. It is a pleasure to do that because the book is a contribution to the cause of capacity building for development and implementation of environmental law in Africa, a goal towards which I have had an undivided focus over the last two decades. There is still some belief in and outside Africa that for developing countries in general, and Africa in particular, development and implementation of environmental law is not a priority. This belief prevails strongly in many quarters of the industrialised countries. In fact, the view is held either out of blatant ignorance or by some renegade industrialists who fail to appreciate Michael Royston's 1979 thesis that Pollution Prevention Pays.2 That group, for obvious reasons, must have their correspondent counterparts in Africa to provide hope that industries rejected as derelict in the West or inoperable due to rigorous environmental regulation, can find homes to which they can escape and dump their polluting industries.

The Law and Politics of Sustainability explores efforts made to address pressing environmental concerns through legislation, conventions, directives, treaties, and protocols. Articles explain the mechanics of environmental law, the concepts that shape sustainable development, case studies and rulings that have set precedents, approaches to sustainable development taken by legal systems around the world, and more. Although non-binding, the Model Law significantly influenced the access to information landscape on the continent. Since the adoption of the Model Law, the Commission adopted several General Comments. The AU similarly adopted Model Laws such as the African Union Model Law on Internally Displaced Persons in Addressing Internal Displacement in Africa. This collection of essays inquires into the role and impact of soft law standards within the African human rights system and the AU generally. It assesses the extent to which these standards induced compliance, and identifies factors that contribute to generating such compliance.
