Wat. kins and others, as hose company No. 14, (confirmed by the Board of Aldermen, ) respectfully REPORT: That your Committee in the examination of this document, deemed it advisable to have the Fire Commissioners before them, and, failing to procure their attendance by the usual notice, were obliged to subpena them. Your Committee had been informed that other parties' desiring to be organized as a hose company in this district, had no opportunity given them by the Commissioners for a hearing, although their application was first presented; and at a meeting of the Committee, held February 231858, Mr. Wright, President of the Boardof Commissioners, and Mr. Schenck, another Commissioner, were present, and refused to answer the interrogatories of the Committee on this point, stating that the document containing the action of the Commissioners had been sent to the Common Council, and they could approve or reject it, as they thought proper. Your Committee, therefore, can only report that the essential purposes for which the subject was referred to the Committee, (an investigation into its merits, ) have been frustrated, through the refusal of the Commissioners to give the information which they alone are competent to impart. Under these circumstances, your Committee would recommend a non-concurrence with the action of the Board of Aldermen, and submit for adoption the following resolution, viz: Resolved, That Document No. 471, from the Board of Fire Commissioners, in favor of organizing John O. Watkins and others, as hose company No. 14, be and the same is hereby sent back to said Board for reconsideration. J. H. BRADY, Committee on G. M. PLATT, Fire Department. Resolved, That Twenty-first street, between Tenth and Eleventh avenues, be lighted with gas; the same to be done under the direction of the Street Commissioner, and at his earliest convenience. Which was laid over. By Councilman Stephen Roberts: Whereas, Persons in the interest of railroad companies have laid a railroad track from West street to the main gate at Castle Garden, across the Battery, without the authority of law; therefore, Resolved, That the Corporation Counsel be requested to enter proceedings immediately, to have the railroad track removed, and the person, persons, or company prosecuted for trespassing on the public grounds of the city of New York. Councilman Flynn moved that said resolution be amended by adding thereto the following words: " That a penalty of one thousand dollars per day is hereby fixed for each day's neglect to remove said track after due notice; and the Corporation Counsel is hereby directed to sue for the same, in behalf of the city, and not to compromise, settle, or discontinue such suit without first obtaining the sanction of the Common Council." Which was accepted by Councilman Roberts. Subsequent to debate--Councilman Roberts withdrew said resolution. MOTION. Councilman Flynn moved that the present order of business be suspended for the purpose of taking up papers from the Board of Aldermen. Which was carried.
