Opening Markets For Foreign Skills How Can The Wto Help

The Mode 4 commitments of WTO Members are narrow and shallow. Even though trade negotiations for enhanced Mode 4 access started well before the launch of the DDA- prospects for success are thin. These negotiations followed a traditional mercantilist approach- with limited attention to the underlying difficulties countries face in letting people into their borders, either generally, or on the basis of a WTO GATS commitment. This Book argues that this approach alone will not succeed. It proposes a focus not on trading market access concessions only, but on discussions aimed at understanding each other's regulatory approaches. To date, in terms of the literature available, we know very little about how WTO Members are managing their Mode 4 commitments. We know even less about how the WTO could learn from clearly more advanced steps in regional liberalization processes. This Book addresses these issues- through case studies of market access and national treatment commitments, and regulatory approaches in Economic Integration Agreements of a select group of WTO Members.

In recent decades, the global economy has experienced a profound transformation due to trade integration and technological progress as well as important political changes. This transformation has been accompanied by significant positive effects at the global level, as increased trade integration has helped to raise incomes in advanced and developing economies, lifting millions out of poverty. At the same time, it has translated into changes experienced by individuals, companies and communities. While overall, better job opportunities are on the rise, workers who are forced to leave their existing jobs may find it difficult to share in these improvements. Policies aimed at facilitating adjustment can reduce the number of those left behind by trade or technology, while at the same time raising the net gains from these developments, improving overall efficiency and boosting incomes. Given the role of skills in productivity and in trade performance as well as in access to employment and wage distribution, a strong emphasis on skills development is vital for both firms and workers. This publication argues that in the current fast-changing context of globalization, where technology and trade relations evolve rapidly, the responsiveness of skills supply to demand plays a central role not only from an efficiency perspective, but also from a distributional perspective. Featuring results from the ILO's Skills for Trade and Economic Diversification (STED) programme, this report shows that appropriate skills development policies are key to helping firms participate in trade, and also to helping workers find good jobs. The right to food has been recognized in Art. 25(1), Universal Declaration of Human Rights, 1948, and further elaborated in Art. 11(1), International Covenant on Economic, Social and Cultural Rights, 1966 (ICESCR). 1 Art. 11(2), ICESCR, refers also to the right to be free from hunger, which is the only right referred to as a 'fundamental' right. And, yet, according to the most recent estimate of the United Nations Food and Agriculture Organizations (FAO), made public in October 2009, ca. 1.02 billion people are undernourished worldwide, a sizable increase from the FAO's 2006 estimate of 854 million people. 642 million of them live in Asia and the Pacific, and 265 million in Sub-Saharan Africa. Hungry people can hardly survive. They are poorly equipped to make a living in the 21st Century. Illiteracy is high. Healthcare is scarce or nonexistent. Life expectancy is short. It is a shame for the world to have such a large number of hungry people among us. It is submitted that this deplorable situation is by no means a hopeless one with only a bleak future ahead. The countries in which the poorest people live are not all poor. Some are even rich with minerals and natural resources. Some other countries have good quality farmland which is much greater than the area actually farmed. There is an enormous unexploited potential to grow food. Yet, the exploitation of this vast potential requires a change of approach. Instead of focusing on how to increase international aid, which has so far failed to alleviate the plight, the effort has to be made to create and maintain a market order in which people will have the opportunity to thrive on their own. To that end, there is need for a world trading system which is guided by abstract rules of just conduct, such as the two general principles of WTO/GATT law, namely the Most Favored Nation ('NFN') Treatment and National Treatment ('NT'). As will be shown, not all rules of the WTO/GATT law operate indiscriminately. A good number of them have been heavily influenced by interest groups in developed countries, which have made them result-oriented and tilted the playing field in their favor, imposing heavy burdens not only on the general public in their own countries, but also, and especially, on people in developing countries (DCs) and least developed countries (LDCs) whose livelihood has been reduced to barely subsistence level. These deficiencies must be corrected, but that would not suffice. The abstract rules of just conduct need to be complemented by rules of competition law. 'Competition is not merely the only method which we know for utilizing the knowledge and skills that other people may possess, but it is also the method by which we all have been led to acquire much of the knowledge and skills we do possess'. The importance of competition is not due to the fact that people act rationally, but just the other way around: it forces people to act rationally. If not hindered, it provides them with the signals that they should follow in deciding what they could best produce at prices which buyers will find attractive. By acting as a discovery procedure, it encourages innovation, entrepreneurship and development of talents and skills. This contribution seeks to explore the link between world hunger and the deficiencies in the world trading system. Accordingly, this paper will address the causes for hunger; the failure of international aid to alleviate hunger; the deficiencies of the world trading system in addressing this situation; Market-Distorting Behavior of Multinational Enterprises ('MNEs'); the need for international competition law rules; and, finally, conclusions.

This edition analyses how trade can contribute to economic diversification and empowerment, with a focus on eliminating extreme poverty, particularly through the effective participation of women and youth. It shows how aid for trade can contribute to that objective by addressing supply-side capacity and trade-related infrastructure constraints, including for micro-, small- and medium-sized enterprises notably in rural areas.

This research explores how multilateralism in trade has worked over the past twenty years - and provides some lessons about how it can work in the future. It describes the WTO's achievements across a number of key areas, including: strengthening the institutional foundations of the trade system; widening its membership and increasing participation; deepening trade integration through lower barriers and stronger rules; improving transparency and policy dialogue; strengthening dispute settlement; expanding cooperation with other international organizations; and enhancing public outreach. It concludes that the WTO has achieved much over its first twenty years but the success of the WTO has inevitably given rise to new challenges.

The Role of Trade in Ending Poverty looks at the complex relationships between economic growth, poverty reduction and trade, and examines the challenges that poor people face in benefiting from trade opportunities. Written jointly by the World Bank Group and the WTO, the publication examines how trade could make a greater contribution to ending poverty by increasing efforts to lower trade costs, improve the enabling environment, implement trade policy in conjunction with other areas of policy, better manage risks faced by the poor, and improve data used for policy-making.
