Ganshof et Charles Petit it la demande du Ministre de la Justice des Pays-Bas. ElIe ne peut cependant pas etre consideree comme une traduction officielIe; son but essentiel a ete de mettre ce nouveau texte it la disposition de ceux qui, tout en n'ayant pas une connaissance suffisante de la langue neerlandaise, veu lent s'informer du droit en vigueur aux Pays-Bas, que ce soit it l'occasion de litiges d'ordre judiciaire ou d'etudes de droit compare. Le texte neerlandais du livre I a ete arrete par les lois des I I decembre 1 1958, Stb. 590 et 591, et 3 avril 1969, Stb. 167. Le livre I est entre en vigueur Ie ler janvier 1970, et a ete modifie par les lois des 24 decembre 1970, Stb. 612, 31 mars 1971, Stb. 397, 6 mai 1971, Stb. 290 et 17 fevrier 1972, Stb. 85. La loi du 6 mai 197 I, modifiant les regles en matiere de divorce et de separation de corps, est d'une importance particuliere. Handbook providing a general introduction to Dutch law in the English language covering the whole system in its different branches such as private law, criminal law, constitutional la, fiscal law, economic law, labour law and international law.

The aim of the book is to highlight the law and economics issues confronting civil law countries.

Almost twenty years after its first edition, and five years after its second edition, The long-awaited third edition of Introduction to Dutch Law is now available in both hardback and paperback. This edition has incorporated most of the major changes in Dutch law, such as the revisions in the Constitution in 1983. In the 1980s, The Dutch criminal justice system lost some of its liberal characteristics of the 1970s, and, finally, The publication of the third edition comes just after the new Civil Code and General Administrative Law Act have entered into force. The impact of European law has increased considerably And The growing importance of environmental law has justified devoting a full chapter to this subject. Moreover, a continuous stream of case law and legislation has also necessitated updating the book. All these changes have led to important modifications as compared To The first two editions. For practical reasons, The order of the chapters has remained virtually unchanged. The 23 chapters in the book are divided into five parts: The Dutch Legal System, Private Law, Public Law, Labour Law and Legal Philosophy. In order to increase its usefulness for foreign students, The original --mainly Dutch-language--Bibliography has been extended to include a Bibliography of foreign publications on Dutch law. The editors have prepared this book under the auspices of the Netherlands Comparative Law Association. Many of the original contributors have collaborated in this revision; they have been joined by a new generation of comparative lawyers.

The nineteen outstanding contributors to this deeply insightful book concur in envisioning a fundamentally new systematic concept of contract law that, while preserving the essential and‘architectureand’ of the existing European codes, would nonetheless find cogent ways to integrate such modern developments as mass transactions, chains and networks of contracts, regulation of markets and contracts to protect consumers, and service and long-term contracts into an optional European code. The book is organised along three major avenues: and• the systematic arrangement of a contract law code - how it deals with core questions of formation and performance or breach of contract, such as mistake and misrepresentation, standard contract terms, and remedies in the case of breach of contract; and• the apparent necessity to merge consumer contract law (i.e. such issues as product safety and liability, warranties, and consumer debt and insolvency) with traditional core contract law concepts; and and• the importance to substantive contract law of the pre-contractual phase, in which information duties are becoming steadily more paramount. The authors perspectives cover a wide range of jurisdictions, including new EU Member States. The bookand’s commitment to an integration of comparative law, EC law, and the debate on European codification offers practitioners and academics fertile ground for the development of a new model of contract law that is more than a common denominator of what has been in force so far. This model may serve as a basis for Europe-wide and perhaps even worldwide discussion.
