Le principe de reconnaissance mutuelle des décisions judiciaires en matière pénale vise à mettre en place un système de libre circulation des décisions judiciaires pénales au sein de l'Union européenne. Ce système est fondé sur le principe de confiance mutuelle qui implique la présomption que les systèmes pénaux des Etats membres respectent les droits fondamentaux, tels qu'ils sont garantis dans l'ordre juridique de l'Union. Le respect des droits fondamentaux devient ainsi un élément clé pour l'acceptation et l'application de la reconnaissance mutuelle en matière pénale. Envisagés sous une forme dialectique, les rapports entre le principe de reconnaissance mutuelle des décisions judiciaires pénales et les droits fondamentaux impliquent une communication et un impact réciproques. Obligatoire dans le contexte de la matière pénale, ce dialogue démontre la soumission du principe de reconnaissance mutuelle à l'influence des droits fondamentaux. Ainsi, leur respect encadre non seulement sa construction par le législateur de l'Union mais également son application par le juge national et son interprétation par le juge de l'Union. Finaliste puisqu'il a lieu dans le contexte de l'intégration européenne en matière pénale, ce dialogue révèle la soumission des droits fondamentaux à l'influence du principe de reconnaissance mutuelle. Ainsi, les standards de protection des droits fondamentaux au sein de l'Union européenne sont définis conformément au principe d'effectivité du droit de l'Union ainsi qu'au principe de confiance mutuelle, deux principes qui conditionnent la mise en œuvre du système de libre circulation des décisions judiciaires pénales au sein de l'Union européenne.

In the EU's fast-growing Area of Freedom, Security and justice, the principle of mutual recognition should play a key rote in the field of judicial cooperation in criminal matters. Since mutual recognition was enshrined as a cornerstone of judicial cooperation in the EU by the European Council of Tampere in 1999, an increasing number of binding instruments based on this principle have been adopted in the framework of the EU's Third Pillar. The considerable impact of those instruments on national criminal legal systems has often required a major effort by Member States in adjusting their national legislation so that it complies with the new mechanisms agreed at EU level. What are the real difficulties encountered by Member States in the transposition of these legislative texts into national law and, even earlier, when the texts are being negotiated within the Council of the EU? What tessons can be learned from the early years of their practical implementation by the competent judicial authorities? And, above ail, what will be the future rote and scope of the principle of mutual recognition in criminal matters in Europe? The entry into force of the Lisbon Treaty and the adoption of a new multi-annual programme (replacing the Hague Programme) to strengthen the EU's Area of Freedom, Security and Justice are both pending. In this crucial time of transition and uncertainty, the book seeks to provide answers to the above questions and many other related issues. Within the framework of the European Commission's Falcone programme, the Belgian Interdepartmental Residues Cell set up the BUFALAW- project for the study of the legislation and the organisation concerning the fight against the illegal use of growth promoters in stock farming in the Member States and candidate countries of the European Union. This book contains the results of the comparative study that was established by Ghent University, which provides a comparative analysis of the arrangements across 19 European States concerning the fight against the illegal use of growth promoters in stock farming. The year 2000's most significant international event was, almost certainly, neither political nor military, but scientific - the announcement, in June, that the human genome had been almost totally decoded. Future generations may well see this as a major turning point, opening the way to radical changes in diagnosis, prognosis, and medical treatment. Often compared with the space programme, this vast enterprise still generates misgivings: this new power, which human beings now have, to modify the genetic heritage of living creatures raises fundamentally new ethical questions - and society as a whole will have to find the answers. In fact, the accelerating pace of scientific and technical progress seems to be reviving atavistic anxieties, some rational, others less so. Recent public-health crises, including the mad cow disease' scare, which lasted into 2000, have fuelled these fears. The public's rejection of GMOs (Genetically Modified Organisms) - verging on a crusade in some countries - tells its own story. As regards conflict, 2000 saw the Middle East peace process grind to a halt, and the Intifada resume. In Europe, the situation in Kosovo and Chechnya, both the scenes of fighting in 1999, stayed precarious. Peace and democracy did score some successes, however, particularly in Europe: the centre-left's victory in Croatia, sweeping former President Tudjman's party off the scene, the democratic party's triumph in Bosnia, and the fall of the Milosevic regime in Serbia.
