Master's Thesis from the year 2014 in the subject Law - Comparative Legal Systems, Comparative Law, grade: 1,3, University of Bonn, course: Lebensmittelrecht, language: English, abstract: In July 2013, negotiations concerning the Transatlantic Trade and Investment Partnership (TTIP) were initiated. Objective of the negotiations is the generation of a Free Trade Agreement (FTA) between the United States (U.S.) and the European Union (EU) to promote trade by reducing trade barriers, including tariff and non-tariff ones. In order to achieve this goal, several issue barriers have to be addressed, inter alia concerning non-tariff barriers including regulatory differences in the sectors of agriculture and food production. While the U.S. and the EU both have high standards concerning the consumer protection and food safety assessment, differences in the basic principle and implementation persist. Both countries pursue an agreement that follows the respective principles and still provides effective trade stimulation. However, based on the rooted differences in the particular food safety systems, challenges are inevitable. The objective of this study is the presentation of the U.S. and EU food safety system as well as special cases highlighting the differences between both systems in terms of risk assessment, prevention, responses and risk communication. The different factors are analyzed both theoretically and on the basis of practical examples. Additionally, the different matters are described in the context of the TTIP to identify issues that may complicate the negotiations. Possibilities to resolve those issues are discussed and recommendations for positive outcomes given.

Government health, safety, and environmental standards have, in the past two decades, often created barriers to international trade. These non-tariff barriers have become the focus of trade disputes, negotiations, and agreements. This book explains the dynamics of conflict and cooperation over consumer and environmental regulation between the European Union and the United States. It explores the most celebrated cases of transatlantic conflicts over regulatory standards—the EU's beef hormone and legtrap bans, and America's fuel economy regulations—as well as the successes of the two partners in coordinating rules for chemical and drug testing, animal inspection, and the reduction of ozone-depleting chemicals. David Vogel argues that transatlantic regulatory conflict has less to do with protectionism and more to do with deeply rooted differences in cultural values and political priorities in Europe and the United States. These differences, he explains, constitute a fundamental and ongoing source of trade conflict between the EU and the U.S. The pattern of EU-U.S. regulatory relations has important implications, not only for the United States and Western Europe, but for the entire global economy. Whatever regulatory standards both adopt become de facto global standards. Its supporters maintain that TTIP will produce spectacular growth and job creation; claims that are wholeheartedly rejected by its critics, who regard TTIP as a direct assault on workers' rights, health and safety standards and public services. In this incisive analysis, Gabriel Siles-Brugge and Ferdi de Ville scrutinize the claims made by TTIP's cheerleaders and scaremongers to reveal a far more nuanced picture behind the headlines. TTIP will not provide an economic 'cure-all', nor will it destroy the European welfare state in one fell swoop. Oliver Ziegler raises the question of what role economic interests of the United States play in the regulatory decision making process of the European Union. Critics often assume that U. S. dominance in the world economy, fueled by a powerful business elite, has significantly affected EU regulations at the expense of environmental and consumer protection standards. The author falsifies this proposition. He shows, first, that the EU often adopts regulations against the explicit opposition of the U. S. thereby ignoring the principles of transatlantic regulatory cooperation. Second, he demonstrates that business interests in the EU are usually not homogenous and often come second to environmental and consumer concerns. In addition, the author shows the increasing role of the European Parliament in EU regulatory decison making.

The book uses the notion of ‘contentious market regulation’ to examine contemporary EU Free-Trade Agreements (FTAs) with industrialised countries: the Transatlantic Trade and Investment Partnership with the USA (TTIP), the Comprehensive Economic and Trade Agreement with Canada (CETA), the EU-South Korea Agreement (KOREU), and the EU’s agreement with Japan (EU-Japan). It also analyses cross-cutting issues affecting trade policy, such as business dimensions, social mobilisation, parliamentary assertion, and investment.
