Designing Public Procurement Policy In Developing Countries

This book presents effective strategies for developing countries to leverage their public sector demand for manufactured imports to promote industrialization, trade, and technology transfer. Technology transfer and its absorption is considered one of the most crucial and complicated challenges for developing countries, which are characterized by insufficient infrastructure, low technological intensity of the domestic capital stock, and high levels of manufactured imports. Which strategies and policy tools can governments employ to link demand with technology transfer, thereby enhancing absorption capacity and development in emerging economies? This book is part of a broader project launched by PGlobal Global Advisory and Training Services Ltd., in cooperation with Istanbul Commerce University (İTUCU) and the Scientific and Technological Research Council of Turkey (TÜBİTAK). The contributors to this book are policymakers, academicians, and experts who are working together to identify problems and develop policy recommendations for public procurement with respect to economic development. The book includes theoretical, empirical, and case study analyses of technology transfer mechanisms, public procurement policies, and countertrade and offset strategies. The lessons learned from these chapters will be of interest to both academics and policymakers concerned with technology transfer, industrial policy, and economic development.

The decision not to launch negotiations in the World Trade Organization (WTO) on three of the Singapore Issues in the so-called July 2004 package provides an opportunity to revisit the knowledge base on which proposals for further international collective action may be drawn. This paper examines the available evidence on public procurement practices in developing countries that could be relevant to further multilateral rule making on state purchasing. Although there is considerable agreement on ends (efficient, non-corrupt, and transparent public purchasing systems), little information is available on means and, in particular, on the effective and replicable strategies that developing countries can adopt to improve their public procurement systems. A concerted effort to substantially add to the knowledge base on public procurement reforms in developing countries, through targeted research and international exchange of information on implemented procurement policies and outcomes, is critical to identifying areas where further binding multilateral disciplines may be beneficial.

This edited collection fills a significant gap in the literature by gathering contributions from the most prominent academics and practitioners of aid and procurement. It explores the economic, political and legal relationship between procurement and aid effectiveness in developing countries, and takes stock of current debates in the field. More specifically, the contributions analyse the failures and successes of current initiatives to foster effectiveness and streamline the aid procurement process, and address current themes emerging in the literature related to development, procurement and aid success. The multilateral development banks cumulatively channel billions of dollars annually in development assistance to borrower countries. This finance is usually spent through processes that incorporate the public procurement regulations of the banks and it is often a condition of this finance that the funds must be spent using the procurement regulations of the lender institution. This book examines the issues and challenges raised by procurement regulation in the multilateral development banks. The book examines the history of procurement regulation in the banks; the tripartite relationship created between the banks, borrowers and contractors in funded procurements; the procurement documents and procurement cycle; as well as how the banks ensure competition and value for money in funded procurements. The book also examines the banks' approach to sustainability concerns in public procurement such as environmental, social or industrial concerns; as well as how the banks address the issue of corruption and fraud in funded contracts. Another issue that is addressed by this book is how the banks have implemented the aid effectiveness agenda. It will be seen that the development banks have undertaken steps to harmonise their policies and practices, increased borrower procurement capacity, taken steps to reduce the tying of aid, and play an important role in the reform of borrower procurement systems, all in an effort to improve the effectiveness of development finance. The book also considers the contractual and other remedies that are available to parties that may be aggrieved as a result of a funded procurement. The book analyses, compares and contrasts the legal, practical and institutional approaches to procurement regulation in the World Bank, the Inter-American Development Bank, the African Development Bank, the Asian Development Bank and the European Bank for Reconstruction and Development.

Since the end of the 1990s, Sustainable Public Procurement (SPP) is discussed as a policy instrument to further sustainability in the economy and society. SPP is an approach that integrates social, environmental and economic considerations in all stages of the public procurement process, from pre-qualification to contract compliance. The concept of SPP includes raising awareness, removing adverse budgetary incentives and promoting product standards. There are many arguments in favour and against SPP. The discussion in this paper concludes that SPP is desirable because the effect on the environment could be substantial, the government's credibility to promote sustainability is enhanced, and the effectiveness of other environmental policies is expected to increase. In developing countries, SPP does not receive adequate attention. By financing projects and programs in developing and transition countries, International Financial Institution like the Asian Development Bank and the European Bank for Reconstruction and Development set rules on public procurement and thus have the potential to influence procurement practices. In the paper at hand, procurement policies, rules and regulations from ADB, EBRD, UNCITRAL and WTO are screened and examined whether they support and further SPP in developing countries. In addition, representatives from the development banks and national procurement agencies expressed their experiences. In ADB's and EBRD's operations and project design, sustainability is an important element, however, the sustainability of procurement in not treated as a priority. There are several documents that promote or indicate the need of sustainability in public procurement but on an application-level pure economic consideration (e.g. lowest price) are often predominant. ADB integrates sustainability mainly in technical specifications where as EBRD's focus is more on award criteria. However, in none of the examined develop.

This book assesses developmental experience in different countries as well as British expansion following the industrial revolution from a developmental perspective. It explains why some nations are rich and others are poor, and discusses how manufacturing made economies flourish and spur economic development. It explains how today’s governments can design and implement industrial policy, and how they can determine economically strategic sectors to break out of Low and Middle Income Traps. Closely linked to global trade and (im)balances, industrialization was never an accident. Industrialization explains how some countries experience export-led growth and others import-led slowdowns. Many confuse industrialization with the construction of factory buildings rather than a capacity and skill building process through certain stages. Industrial policy helps countries advance through those stages. Public Procurement accounts for 6.5 trillion euros annually and plays a fundamental role in achieving the Sustainable Development Goals. All public services and functions depend on public procurement to be delivered. This report aims to draw attention to the “added value” that sustainable public procurement can contribute towards these goals, directly or indirectly, going beyond delivering core public sector objectives. The report establishes clear linkages between Sustainable Public Procurement and the SDG targets, and aims to validate those linkages with specific and real-life case studies from Nordic settings.
