Excerpt from The Law of Pleading in Civil Actions and Defenses Under the Code, Vol. 2: Also Practice in Appeal and Error With Numerous Forms and Precedents, With Special Reference to the Ohio Code Sec. 727. Interpleader Nature and extent of the rem-f edy. A bill of interpleader is a bill filed for the protection of a person from whom several persons claim legally and equitably the same thing, debt or duty, but who has incurred no independent liability to any of them, and does not himself claim an interest in the matter.1 The ground of jurisdiction is the apprehension of danger to the person seeking the rem edy, from doubtful and conflicting claims, and the only relief to which he is entitled is to have liberty to pay the money to the persons entitled to it.' The code interpleader invokes neither the common-law nor chancery powers of the court by an original common-law or chancery action. The jurisdic tion conferred on the court is purely statutory.'
