Excerpt from Commentaries Upon Martial Law: With Special Reference to Its Regulation and Restraint (a) The case of Thomas of Lancaster, in which Parliament declared the execution illegal, because it was in time of peace (in tempore pacis); and both Coke and Hale cite this as a case of martial law. The Lord Chief Justice in citing the case, omits the material words, in tempore pacis, which Coke and Hale point out as the ground of the decision.
