Excerpt from Cases on the Law of Personal Property The purpose of this book is to set out and illustrate by concrete cases these fundamental principles. In selecting these cases, the author has kept in mind two things; viz., first, to include no case based on obsolete law; second, to include only so much of the case as is in point. The cases have also been arranged in such a way as to develop, in a logical order, the legal principles under discussion. As a further help to the student, a topical heading has been used for each case or group of cases the purpose being to give the student something definite to look for. The heading, however, in no instance, reveals the holding of the case, for the author has been as careful to pre vent legal conclusions being drawn from the headings as he has been particular in selecting suitable headings. The cases selected are of such a type and variety as to illustrate, in a comprehensive manner, the underlying principles of the law of Personal Property. The Fourth Edition continues the emphasis on real-life problems and transactions that has distinguished these teaching materials for decades. As in previous editions, the Problems are tailored to focus the student's attention on the relevant statutory language and its application to common patterns of secured financing. They emphasize counseling, planning, drafting, and litigation skills. In addition to more traditional Problems, which ask the student to predict the outcome, many of the Problems ask the student to give advice to clients, to structure transactions, and to draft certain provisions of documents. As in the Third Edition, many of the Problems are based upon Prototype transactions that feature actual transaction documents. The first'financing an automobile dealer's inventory and financing a consumer buyer's purchase of an automobile from the dealer'affords the basis for a discussion of basic Article 9 concepts in a concrete setting. The second Prototype features an accounts and inventory ?borrowing-base? secured credit facility and includes a revolving credit agreement and security agreement. This Prototype forms the basis for detailed coverage of various types of financing secured by receivables and other intangible property.

Landmark Cases in Property Law explores the development of basic principles of property law in leading cases. Each chapter considers a case on land, personal property or intangibles, discussing what that case contributes to the dominant themes of property jurisprudence – How are property rights acquired? What is the content of property rights? What are the limits or boundaries of property? How are property rights extinguished? Individually and collectively, the chapters identify a number of important themes for the doctrinal development of property institutions and their broader justification. These themes include: the obscure and incremental development of seemingly foundational principles, the role of instrumentalism in property reasoning, the influence of the law of tort on the scope of property doctrines, and the impact of Roman legal reasoning on the common law of property. One or more of these themes (and others) is revealed through careful case analysis in each chapter, and they are collected and critically explored in the editors' introductions. This makes for a coherent and provocative collection, and ensures that Landmark Cases in Property Law will be lively and essential reading for scholars, practitioners, and all those interested in the development of property principles at law.
