Since the early 1970's there have been significant changes in the conditions governing the exploitation of marine fishery resources. These changes include the generalized extension of national jurisdiction over fisheries to 200 nautical miles; the decline in the rate of growth of world catch and the growing evidence of limits to supply; and the changes in economic conditions including the rise in fuel prices and the economic recessions. These changes have had significantly different effects on different countries. This document contains case studies of the effects on eight countries: Argentina, Australia, Cuba, Kiribati, Malaysia, Morocco, Norway and Poland.

With the growing scarcity of fish resources, instruments of fisheries management become crucial. This publication suggests a legal approach to this isssue, and focuses on six case studies: Indonesia, Kenya, Namibia, Brazil, Mexico and the EU. The case studies are preceded by an analysis of the international law requirements concerning fisheries management, with a focus on fisheries in Exclusive Economic Zones. The final part of the book summarises the case studies and develops a proposal for a 'legal clinic' for fisheries management.

This collection addresses the central question of how the current international framework for the regulation of fisheries may be strengthened in order to meet the challenges posed by changing fisheries and ocean conditions, in particular climate change. International fisheries law has developed significantly since the 1990s, through the adoption and establishment of international instruments and bodies at the global and regional levels. Global fish stocks nevertheless remain in a troubling state, and fisheries management authorities face a wide array of internal and external challenges, including operational constraints, providing effective management advice in the face of scientific uncertainty and non-compliance by States with their international obligations. This book examines these challenges and identifies options and pathways to strengthen international fisheries law. While it has a primarily legal focus, it also features significant contributions from specialists drawn from other disciplines, notably fisheries science, economics, policy and international relations, in order to provide a fuller context to the legal, policy and management issues raised. This Draft Marine Bill (Cm. 7351, ISBN 9780101735124) contains the following: a policy paper; the draft Marine Bill and explanatory notes; an impact assessment. The Bill sets out the Government's approach to a number of marine related issues, including environmental protection of the coastal marine environment and the seas surrounding the coast as well as access to the coastal environment for recreation. The legislation set out in this Bill was originally proposed in "Sea Change", a Marine White Paper, published in March 2007 (Cm. 7047, ISBN 9780101704724). The White Paper itself had proposed a strategic system of marine planning to balance conservation, energy and resource needs, using the principle of sustainable development. The Draft proposals in this Bill puts the earlier proposals of the White Paper into a legislative framework, which includes: the creation of the Marine Management Organisation; deliverance of new marine planning systems, including establishing new powers to enable the Government to put in place a network of marine conservation zones to protect marine life; better licensing decisions for licensing activities in the seas; reforms to a range of marine, migratory and freshwater fisheries management arrangements; allow greater access to the English coast.
