A Legal Response To Child Trafficking In Africa

Human trafficking has emerged over the past three decades as an issue of considerable concern for the international community, and governments around the world have committed themselves to enacting legislation to combat the trade in humans. This has resulted in the adoption of international standards and important obligations of governments, to address the trafficking in persons (TIP) and in particular child trafficking which appears as a worldwide form of modern-day slavery, and a facet of transnational organized crime. This study investigated the potential causes of this state of affairs, which could be the inadequacy of legal texts and absence of implementation mechanisms, lack of co-ordination amongst the actors implicated, the insufficiency of political will to respond to the problem, the permeability of borders, or the lack of information in the accounts of victims and their parents. The principle objective aimed to address and ensure safety, special protection and security to child victims of trafficking. In so doing this study identified the existing legal framework in the international and regional environment.

Human trafficking and particularly child trafficking is a issue of considerable concern all over the world. As a modern-day slavery, fighting this practice has brought together governements, civil society organisations, researchers, etc to address the problem and find proper solutions. A number of international and regional conventions have been adopted; numerous pieces of legislation has also tried to tackle the plague at the national level. Yet, the phenomenon is continuing at dangerous proportions. Are the legal texts adequate or is it simply the lack of implementation or co-ordination measures on the ground? The assessment of the situation on the ground in South Africa and Benin will suggest new ways to counter child trafficking on the ground.

This edited volume examines the contemporary practice of human trafficking on the African continent. It investigates the scourge of human trafficking in Africa from the broader international and regional perspectives as well as from a country-specific context. Written by a multi-disciplinary panel of academics and practitioners, the book is divided into three sections that highlight a wide range of issues. Section One examines the theoretical and legal challenges of trafficking. Section Two focuses on the regional and nation-state perspectives of human trafficking along with selected cases of trafficking. Section Three highlights the impact of trafficking on youth, with specific attention given to child soldiering and female victims of trafficking. The United Nations 1989 Convention on the Rights of the Child (CRC) constitutes a landmark in the development of international human rights law and reflects an historic turn in universal thinking about children and their rights. Many children in Africa today face the future with a deep sense of uncertainty and foreboding. Many have no hope of education and the issues of child trafficking, sexual exploitation and child labour reflect a profound crisis of the family. The current socio-economic situation has radically changed the world views and the life expectations of the African child. This book attempts to respond to some of the questions that could be asked: to what extent have the provisions of the CRC been implemented in the national legislations of African States? What effect have they had on children in Africa? What mechanisms exist to prevent and sanction rights abusers? Are children's rights in Africa reality, or simply rhetoric?

The 2020 UNODC Global Report on Trafficking in Persons is the fifth of its kind mandated by the General Assembly through the 2010 United Nations Global Plan of Action to Combat Trafficking in Persons. It covers more than 130 countries and provides an overview of patterns and flows of trafficking in persons at global, regional and national levels, based primarily on trafficking cases detected between 2017 and 2019. As UNODC has been systematically collecting data on trafficking in persons for more than a decade, trend information is presented for a broad range of indicators.

This collection is anchored in an African conception of children's rights and the law, and reflects contemporary discourses taking place in the region of the children's rights sphere. The majority of contributors are African and adopt an individual approach to their topic which reflects their first-hand experience. The book focuses on child rights issues which have particular resonance on the continent and the chapters span themes which are both broad and narrow, containing subject matter which is both theoretical and illuminated by practice. The book profiles recent developments and experiences in furthering children's legal rights in the African context, and distils from these future trends the specific role that the law can play in the African children's rights environment.
